MEMBERS PRESENT: Peter Conner, Wendy Longo, Patrick Mulvey-Welsh, William Sims, Robert Richard, and Michael Main.
Mr. Conner called the meeting to order and explained the procedures for the evening.
Re-organization
Mr. Main opened nominations for Chair.
Mrs. Longo nominated Peter Conner.
Unanimously nominated.
Gavel was passed back to Mr. Conner who opened nominations for Vice.
Mr. Richard nominated Mr. Sims.
Unanimously nominated.
Nominations for Clerk.
Mrs. Longo nominated Mr. Welsh
Mr. Sims nominated Mr. Richard
Mr. Richard received three votes.
Mr. Welsh received two votes.

Case No. 3293 – George A. Benway, III – Wareham Road – continued from May 25, 2005
Sitting: Wendy Longo, Patrick Mulvey-Welsh, William Sims, Robert Richard, and Peter Conner.
Attorney Glynn, representing Mr. Benway said the property will be the site of eight units that will be rentals. Mr. Benway will manage the property. The one bedroom units can’t be changed because of the layout. Revised plans were submitted into the record showing a crawl space opposed to a full basement. The landscaping will be a mix of small and large trees.
Mrs. Longo asked the petitioner how the landscaping will be watered.
Mr. Benway replied an irrigation system.
Attorney Glynn reviewed the list of waivers. The lot coverage is 5.2%. A 27’ rear setback is requested, 50’ is required. A 21’ side setback is requested, 30’ is required. The petitioner has no objection to the withdrawal of the waiver request for all other waivers necessary to construct the development as approved by the Board.
Mr. Conner read the report from Saeed Kashi, Town Engineer into the record.
Attorney Glynn reviewed the Falmouth Engineering letters. The driveway will be built to subdivision standards. The sprinkler system would be cost prohibitive.
Mr. Benway said that the materials used on the outside of the building will have an A1 fire rating but they will not have any sprinklers.
Mrs. Longo asked the petitioner how many units are going to be affordable.
Mr. Benway replied two units one being a one-bedroom the other being a two bedroom.
Mrs. Cutler, Kopelman & Paige, asked the petitioner who the monitoring agent would be for the rentals.
Attorney Glynn replied CHAPA.

Attorney Glynn said that the petitioner has not requested any waivers of conservation laws on any wetlands.
Mr. Benway said that the entrance is a driveway not a street. The drainage will be installed even though it is not required on a private drive.
Mr. Conner asked the Board members if they had any concerns that needed to be addressed by the petitioner.
Attorney Glynn asked the Board to close the hearing.
Attorney Cutler strongly urged the Board not to close the hearing until all information is received.
Mr. Conner said that the Board would be reluctant to close the hearing and asked Attorney Glynn to draw up draft conditions and/or a draft decision.
Mr. Conner said that the hearing is continued to August 10, 2005 at 7:30 p.m. and no further notice will be given.

Case No. 3297 – Robert Ankstitus – Taylor Avenue
Mr. Welsh made a motion to approve Case No. 3297.
Mrs. Longo seconded.
Unanimously denied. 0-5
The Board discussed the decision on Case No. 3287 – Peter Fantoni – a revised decision was filed with the Town Clerk correcting the address and removing Condition No. 1.
No further business came before the Board.
